A day after the head of the National Transportation Safety Board told Congress that the deliberate burning of toxic chemicals in five crashed train cars in East Palestine, Ohio last year was unnecessary, a former Environmental Protection Agency official said the so-called “controlled burn” also likely went against EPA regulations.

Kevin Garrahan, who worked for the agency for 40 years and focused on environmental risk assessment and hazardous waste cleanup, told HuffPost that soon after a Norfolk Southern train derailed in the town of 4,700 people, he alerted a former EPA colleague to a 2022 memo on the open burning and open detonation of waste explosives.

The U.S. Environmental Protection Agency announced Thursday that it had begun the process of prioritizing vinyl chloride for evaluation under the Toxic Substances Control Act.

Vinyl chloride, which is primarily used to make polyvinyl chloride (PVC) plastic, was one of five chemicals the agency earmarked for a risk assessment. The move comes eight months after a disastrous train derailment in East Palestine, Ohio, which included five cars carrying 115,000 gallons of the dangerous chemical.

Day After Texas Fire, Report Reveals US Hazardous Chemical Incidents Occur Almost Daily

A shelter-in-place order has been lifted in two Texas counties after a chemical plant fire on Wednesday, which came on the eve of a report showing just how frequent such incidents are across the United States, particularly at sites tied to the fossil fuel industry.

There have been at least 287 hazardous chemical incidents—including explosions, fires, and toxic releases—this year alone, and over 825 since the beginning of 2021, according to the Coalition to Prevent Chemical Disasters’ online database.

Shortly after two progressive lawmakers unveiled legislation that would require more stringent federal regulations for trains carrying hazardous materials, a train carrying propane fuel through Manatee County, Florida derailed and made the latest case for far-reaching action, according to advocates.

Brittany Muller of WFLA News Channel 8reported that “one tanker carrying 30,000 gallons of propane has rolled off the tracks.”

South Manatee Fire Rescue was responding to the derailment, Muller said, in which at least six train cars had left the tracks. Continue reading →

Residents and officials in Harris County, Texas have expressed alarm since learning that contaminated water used to extinguish a fiery train crash in East Palestine, Ohio has been transported more than 1,300 miles to a Houston suburb for disposal.

Houston’s Coalition for Environment, Equity, and Resilience tweeted Thursday: “We are disturbed to learn that toxic wastewater from East Palestine, Ohio will be brought to Harris County for ‘disposal.’ Our county should not be a dumping ground for industry.” Continue reading →

Biden DOJ Supporting Rail Giant Norfolk Southern’s Effort to Block Future Lawsuits

Norfolk Southern—the railroad giant whose train derailed and caused a toxic chemical fire in a small Ohio town earlier this month—has asked the U.S. Supreme Court to throw out a 2017 lawsuit filed by a cancer-afflicted former rail worker, and the Biden administration is siding with the corporation, fresh reporting from The Lever revealed Thursday.

If the high court, dominated by six right-wing justices, rules in favor of Norfolk Southern, it could be easier for the profitable rail carrier to block pending and future lawsuits, including from victims of the ongoing disaster in East Palestine. Moreover, it “could create a national precedent limiting where workers and consumers can bring cases against corporations,” wrote two of the investigative outlet’s reporters, Rebecca Burns and Julia Rock. An investigation published Monday revealed that just weeks before a Norfolk Southern-owned train overloaded with hazardous materials derailed and caused a toxic chemical fire in East Palestine, Ohio, the rail giant donated $10,000—the maximum amount allowed—to help fund the inauguration of the state’s Republican Gov. Mike DeWine.

According to WSYX, the Columbus-based news outlet that conducted the investigation, “This contribution, which is part of $29,000 the Virginia-based corporation has contributed to DeWine’s political funds since he first ran for governor in 2018, is merely one piece of an extensive, ongoing effort to influence statewide officials and Ohio lawmakers.” Continue reading →
