GOP Leaders Push Judiciary to Ignore Policy Designed to End ‘Judge Shopping’

Republican lawmakers on Thursday signaled they want to stop judges from following a new judicial policy unveiled this week that’s aimed at curbing what one journalist called “one of the most outrageous aspects of the American legal system.”

In a letter to the chief justices of U.S. district courts across the country on a new rule regarding the practice of “judge shopping,” Senate Minority Leader Mitch McConnell (R-Ky.) joined Sens. John Cornyn (R-Texas) and Thom Tillis (R-N.C.) in advising the judges that “Judicial Conference policy is not legislation.”

Legal experts said Friday that a federal judge’s ruling in West Virginia illustrates the danger posed by the U.S. Supreme Court’s right wing majority, which ruled this year in New York State Rifle & Pistol Association v. Bruen that restrictions on firearms must fall within the so-called “historical tradition” of gun laws.

U.S. District Judge Joseph Goodwin, who was appointed to the Southern District of West Virginia by former Democratic President Bill Clinton, ruled against a federal law prohibiting people from possessing firearms with serial numbers that have been “altered, obliterated, or removed.” Continue reading

Rights groups and other progressives are demanding a probe of the FBI’s rushed and limited 2018 background investigation into U.S. Supreme Court Justice Brett Kavanaugh after seven Democratic senators on Thursday revealed new details about the bureau’s actions.

Kavanaugh was nominated to the court by former President Donald Trump and narrowly confirmed by GOP senators in October 2018, despite allegations of sexual assault, which Kavanaugh has denied. A newly released letter to lawmakers from the FBI sheds light on—but also raises more questions about—how the bureau handled its investigation of those allegations. Continue reading

Court Requests Probe Into Whether McConnell Unethically Pressured Judge to Retire to Pave Way for His Unqualified Protégé

A federal court has requested an investigation into whether Senate Majority Leader Mitch McConnell unethically pressured a judge on the powerful U.S. Court of Appeals for the District of Columbia Circuit to retire to pave the way for the Kentucky Republican’s 38-year-old protégé Justin Walker, who is set for a confirmation hearing for the vacancy on Wednesday.

The New York Times reported late Monday that on May 1, Judge Sri Srinivasan—chief judge on the U.S. Court of Appeals for the D.C. Circuit—”asked Chief Justice John G. Roberts Jr. to assign another circuit to look into a complaint filed by the progressive advocacy group Demand Justice, which questioned the timing and circumstances of Judge Thomas B. Griffith’s retirement announcement in early March.” Continue reading

Mitch ‘Nuclear Option’ McConnell Poised to Turn Steady Stream of Trump’s Right-Wing Judges Into a Flood

Critics warn that even if Democrats regain control of White House and Senate, the flood of judges could mean there will be no more vacancies to fill post-2020

Senate Majority Leader Mitch McConnell (R-Ky.) is reportedly pursuing a “nuclear option” rule change to make it easier to push through a flood of President Donald Trump’s right-wing judges.

Under the new rules, nominees for lifetime appointments on lower courts would only require a simple majority of votes rather than the current 67. Critics condemned the move as “hijacking” the federal judiciary and pointed out that even if Democrats regain control of the Senate and White House in the next election, they may not have any more spots to fill post-2020.
