GOP Leaders Push Judiciary to Ignore Policy Designed to End ‘Judge Shopping’

Republican lawmakers on Thursday signaled they want to stop judges from following a new judicial policy unveiled this week that’s aimed at curbing what one journalist called “one of the most outrageous aspects of the American legal system.”

In a letter to the chief justices of U.S. district courts across the country on a new rule regarding the practice of “judge shopping,” Senate Minority Leader Mitch McConnell (R-Ky.) joined Sens. John Cornyn (R-Texas) and Thom Tillis (R-N.C.) in advising the judges that “Judicial Conference policy is not legislation.”

As five Big Tech executives appeared before the U.S. Senate Judiciary Committee on Wednesday, the group Ekō released a report highlighting how “social media companies are not only failing to safeguard young users from harm, but actively profiting from it.”

“This briefing serves as an urgent call for legislative action,” says the 17-page publication from Ekō—previously called SumOfUs—which is addressed to the Senate panel on the first page and urges constituents to contact their members of Congress.

In the wake of a series of high-profile scandals surrounding the relationship between right-wing justices and billionaires, the U.S. Supreme Court announced on Monday that it had formally adopted a new Code of Conduct.

The 14-page code is based on requirements for lower court judges, and most of the rules it outlines are not new, the court said. Watchdog groups have been widely critical of the new document, which does not stipulate how the conduct it promotes will be enforced, with the Revolving Door Project labeling it a “toothless PR stunt.”

The U.S. Senate Finance Committee on Wednesday released a report detailing how embattled Supreme Court Justice Clarence Thomas may have had a substantial amount of a loan for a luxury RV forgiven by a wealthy friend—which one watchdog called “a serious ethics issue.”

The panel’s probe was sparked by New York Times reporting from August about Anthony Welters loaning Thomas money to buy a used Prevost Le Mirage XL Marathon, or “the Rolls-Royce of motor coaches,” which cost $267,230 in 1999. Welters told the newspaper that “the loan was satisfied” and provided a photograph of the title with his signature and a handwritten “lien release” date of November 22, 2008.

The $3.5 trillion budget resolution introduced Monday by Senate Democrats and Sen. Bernie Sanders includes billions of dollars for Congress to establish a pathway to citizenship for millions of undocumented immigrants, giving progressives a reason to cheer.

Rights groups and other progressives are demanding a probe of the FBI’s rushed and limited 2018 background investigation into U.S. Supreme Court Justice Brett Kavanaugh after seven Democratic senators on Thursday revealed new details about the bureau’s actions.

Kavanaugh was nominated to the court by former President Donald Trump and narrowly confirmed by GOP senators in October 2018, despite allegations of sexual assault, which Kavanaugh has denied. Over two dozen constitutional law experts on Friday endorsed legislation recently introduced by a trio of House Democrats that would establish 18-year term limits for U.S. Supreme Court justices.

The endorsement letter (pdf) signed by professors and scholars across the country, along with a former U.S. senator and a former chief justice of the Utah Supreme Court, comes as the Senate GOP is trying to confirm right-wing Judge Amy Coney Barrett, President Donald Trump’s third nominee to the high court, before the November general election. Ahead of Senate Judiciary Committee hearings scheduled to start Monday, more than 5,000 lawyers issued an open letter Friday urging senators to “defend the lives and fundamental rights of all Americans” by refusing to confirm President Donald Trump’s U.S. Supreme Court nominee Judge Amy Coney Barrett.

Congressional leaders and the White House have been locked in a political battle over the high court’s empty seat since the death of Justice Ruth Bader Ginsburg  in September. Senate Majority Leader Mitch McConnell (R-Ky.) is reportedly pursuing a “nuclear option” rule change to make it easier to push through a flood of President Donald Trump’s right-wing judges.

Under the new rules, nominees for lifetime appointments on lower courts would only require a simple majority of votes rather than the current 67. Critics condemned the move as “hijacking” the federal judiciary and pointed out that even if Democrats regain control of the Senate and White House in the next election, they may not have any more spots to fill post-2020.
