In what one chief called “a major victory” for Native American tribes, the United States Supreme Court on Thursday upheld a federal law enacted to protect Indian children from being separated from their families.

The justices’ 7-2 decision in Haaland v. Brackeen leaves intact the Indian Child Welfare Act (ICWA), a 1978 law passed in response to over a century of Native American children being taken from their relatives and often placed in state or religious institutions or with white families.

Campaigners and frontline communities celebrated Monday after the U.S. Supreme Court declined to hear five appeals from major fossil fuel companies hoping to shift climate liability cases from state to federal court, where polluters are more likely to prevail.

“Big Oil companies have been desperate to avoid trials in state courts, where they will be forced to defend their climate lies in front of juries, and today the Supreme Court declined to bail them out,” said Center for Climate Integrity president Richard Wiles.

U.S. Supreme Court Associate Justice Amy Coney Barrett on Thursday rejected a challenge to the Biden administration’s student debt cancellation plan, a move anticipated by jurists and journalists alike.

Barrett declined to consider an appeal by Wisconsin Institute for Law and Liberty (WILL)—a conservative law firm that previously drew attention for investigating claims of widespread voter fraud in the 2020 presidential election and coming up empty—on behalf of Brown County Taxpayers Association, a right-wing advocacy group. Abortion rights advocates geared up for a major fight as the U.S. Supreme Court announced Monday it will soon hear arguments in Dobbs v. Jackson Women’s Health Organization, a case in Mississippi which poses a direct challenge to Roe vs. Wade.

The high court confirmed it will consider the case December 1 after months of speculation regarding when it would take up the dispute over Mississippi’s ban on most abortion care after 15 weeks of pregnancy. Continue reading →

Three Democratic lawmakers on Tuesday urged U.S. Supreme Court Justice Amy Coney Barrett to recuse herself from a pending case revolving around the nonprofit arm of Americans for Prosperity, a Koch-funded political advocacy group that spent heavily to ensure Barrett’s confirmation to the bench last October.

In a letter (pdf) to Barrett, Sen. Sheldon Whitehouse (D-R.I.), Sen. Richard Blumenthal (D-Conn.), and Rep. Hank Johnson (D-Ga.) argue that Americans for Prosperity’s big spending campaign in support of the newest justice’s confirmation casts serious doubt on whether she can be impartial in Americans for Prosperity Foundation v. Supreme Court Justice Amy Coney Barrett—confirmed just ahead of President Donald Trump’s 2020 election loss in November—is being called to recuse herself from an upcoming decision regarding a potentially landmark climate case now pending.

“Barrett posing as an impartial judge in this hearing for climate accountability is about as safe as the Big Bad Wolf giving Little Red Riding Hood directions to Grandma’s house,” said Lindsay Meiman, U.S. communications manager at the climate action group 350.org. “We demand Barrett immediately recuse herself of any and all cases concerning climate and the fossil fuel industry, starting with the upcoming Baltimore vs. Big Oil hearing.” Continue reading →
