Reinforcing the worldwide perception of the U.S. as “a bully and a hegemon” that will not tolerate attempts by the global community to hold it accountable for its deadly actions overseas, President Donald Trump’s national security adviser John Bolton is set to deliver a speech on Monday that will reportedly threaten International Criminal Court (ICC) officials with sanctions if they dare to move ahead with probes into U.S. or Israeli war crimes.

“The United States will use any means necessary to protect our citizens and those of our allies from unjust prosecution by this illegitimate court,” Bolton will say at an event hosted by the right-wing Federalist Society, according to a speech draft viewed by Reuters. “If the court comes after us, Israel, or other allies, we will not sit quietly.” Continue reading

In writings and speeches over just the past several months, President Donald Trump’s national security adviser John Bolton and Secretary of State Mike Pompeo have made no secret of their desire to overthrow the Iranian government.

According to a Reuterreport published on Saturday, their desire may finally be converting into concrete action, now that the two ultra-hawks have a firm grip on America’s foreign policy apparatus.

“The Trump administration has launched an offensive of speeches and online communications meant to foment unrest and help pressure Iran to end its nuclear program and its support of militant groups,” Reuters reported, citing anonymous U.S. officials familiar with the effort. “More than half a dozen current and former officials said the campaign, supported by Secretary of State Mike Pompeo and national security adviser John Bolton, is meant to work in concert with U.S. President Donald Trump’s push to economically throttle Iran by re-imposing tough sanctions.” Continue reading

Trump, Congress and the case for Treason

What happens when a sitting president kicks the legs of Democracy’s stool?

President Donald Trump delivered his 2018 State of the Union address on January 20, 2018. Since that time, the consequences and ramifications put forth in that speech are still being discussed after having set new precedents to the tone, nature and policies spelled out to the American people.

Congress has always held the tradition that when the sitting president delivers these speeches, the opposing party withholds applause and ovations for most the speech, and only the most basic and inarguable points receive unanimous approval. Like all traditions in Washington since Trump’s inauguration, this too has now changed.

Agreeing with a critic who called the actions of the democrats “treasonous” and “un-American” for not applauding policies they disagree with, Trump has taken a step into an entirely new territory that should have caused alarm bells to go for all.

“You’re up there, you’ve got half the room going totally crazy, wild—they loved everything, they want to do something great for our country. And you have the other side, even on positive news—really positive news, like that—they were like death and un-American. Un-American,” the president said. “Somebody said, ‘treasonous.’ I mean, yeah, I guess, why not? Can we call that treason? Why not? I mean, they certainly didn’t seem to love our country very much.”

The White House quickly defended Trump’s words, saying it was meant as a joke. When the President of the United States makes a JOKE of calling for the DEATHS of the opposing party’s members of Congress, we have entered a perception and introduction to authoritarian rule and dictatorship. Opposing the president is not punishable by death in the US, and to suggest otherwise demonstrates total ignorance or self-absorption. In fact, the 1st Amendment to the Constitution provides for the right of every American to not only disagree with the government or even the President, but to also assemble together to make their grievances known. Most people know this concept as “protest” or “dissent.”

In service to our country, we have put together a short refresher course about the history of Treason charges in the US since World War II. Let’s begin with what the law states as the punishment for Treason.

“Whoever, owing allegiance to the United States, levies war against them or adheres to their enemies, giving them aid and comfort within the United States or elsewhere, is guilty of treason and shall suffer death, or shall be imprisoned not less than five years and fined under this title but not less than $10,000; and shall be incapable of holding any office under the United States.”
(June 25, 1948, ch. 645, 62 Stat. 807; Pub. L. 103–322, title XXXIII, § 330016(2)(J), Sept. 13, 1994, 108 Stat. 2148.)

One person convicted of treason was Tomoya Kawakita, a Japanese-American sentenced to death in 1952 for tormenting American prisoners of war during World War II. Even such a clear-cut case created qualms; Kawakita was commuted to a life sentence and was eventually deported to Japan and barred from ever entering the United States again.

On June 19, 1953, Julius and Ethel Rosenberg were executed after being convicted of committing espionage for the Soviet Union. They were accused of transmitting nuclear weapon designs to the Soviet Union; at that time the United States was the only country with nuclear weapons. They were also accused of providing top-secret information about radar, sonar, and jet propulsion engines to the USSR. Espionage is considered a treasonable act.

Treason is a serious, non-jokable charge with very unfunny consequences. But don’t overlook this as just another benign statement from an overly-vociferous president. What he is actually demanding here is a One Party System that does not allow dissent or protest, that prevents a press from publishing negative articles and results in job losses of federal employees who oppose his authority.

His latest claim is that if he does not get his way on immigration, he will shut down the government. This holds the American people hostage and in economic jeopardy and is questionably illegal.

The irony in all of this is that for all intents and purposes, this president has walked up to the line of committing Treason himself, and is so close in reality that only legal experts can parse out if or why he has not actually committed that crime. In psychology, this is called “Projectionalism;” to accuse others of what you are carry inside yourself.

Since taking office, Trump has assembled quite a laundry list of things he has done for the benefit of the Russian government.

* Shortly after his inauguration, Russian officials were invited to an Oval Office meeting, in which Trump revealed to Foreign Minister Lavrov secrets that compromised the coordination of intelligence gathering with Israeli operatives, jeopardizing Israeli and the U.S. ability to track down terrorists and proliferates.
* Following the events in the Ukraine in 2014 and Russian interference in the 2016 elections, Congress imposed sanctions against Russia and individual operatives of the Russian government. Since taking office, Trump has refused to take actions to impose these sanctions, despite the fact the law requires him to do so.
* The recent meeting in the United States dealing with cybersecurity and counterterrorism between CIA Director Mike Pompeo and the heads of Russia’s intelligence agencies, one of which is included in the above mentioned sanctions and not allowed travel to the US.
* The Gasleys, a tanker carrying Russian LPG, docked in Boston and unloaded its cargo recently. Russia’s gas and oil industry is currently under sanctions, or is supposed to be at any rate.
* The Nunes memo and the Republican efforts to discredit the FBI and other intelligence services as a way to slow or stop Robert Mueller’s investigation has weakened the trust between Congress and the intelligence community, and has shown sources that their identities may not be protected.
* On April 7, 2017, the Trump administration launched a cruise missile strike against Shayrat airbase in Syria. The US launched 58 cruise missiles at the base, yet the base was operational within two days of the attack. Why? Because Trump had warned the Russians about the attack, so most of the planes, etc. had been moved before the missiles were even launched.

Moreover, words in the State of the Union address called for extending presidential powers and other non-restrictive measures which, in effect, abolish the Rule of Law for the President and his Administration’s activities.

America is now teetering on the balance between being ruled, not governed; in complete spineless fear, the GOP clenches their power at the cost of democracy and nation, shredding the ideals of the Constitution as fast as this administration has shed regulations protecting the American people, environment, public lands and diverse society.

At the fulcrum, we wait for something – anything – to prevent further decay of the country once known as a shining example of democracy.

Sanctions? What Sanctions?

In July of last year, Congress overwhelmingly passed a bill that put new sanctions on Russia. The support was as close to unanimous as you see in Congress these days; only three dissenting votes in the House and two in the Senate.

Facing sure backlash and a veto override if he either vetoed the bill or refused to sign (a pocket veto), President Donald Trump held off until the final day until signing the sanctions bill. Signed without the usual spectacle of a ceremony that the Toddler in Chief seems to thrive on, he called parts of the bill “clearly unconstitutional,” and went on to say they “displace the President’s exclusive constitutional authority to recognize foreign governments” while others exceed Congress’ authority by imposing time limits on the executive branch.

The Trump administration then raised the ire of Congress by missing the deadline for the first part of the sanctions to be put in effect. Which brings us to today’s deadline.

Today was to be the day that the Treasury Department was to begin imposing economic sanctions against people and businesses doing business with Russia’s intelligence and defense sectors. They were also supposed to provide a list of oligarchs maintaining close ties to Putin.

So what did the administration do? They said that they wouldn’t be imposing sanctions. “Sanctions on specific entities or individuals will not need to be imposed because the legislation is, in fact, serving as a deterrent,” said a State Department official.

When Donald Trump became President, he took the oath of office:

“I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the United States, and will to the best of my Ability, preserve, protect and defend the Constitution of the United States.”

Overriding Congress and unilaterally deciding not to enforce a sanctions bill that you yourself signed is not faithfully executing the office. It is not preserving, protecting or defending the Constitution. It’s the type of stunt you see in a third rate banana republic, and not in the United States – until now.

So, what happens next? Will Congress grow a spine and demand that he put sanctions in place? Will they finally admit to themselves that this overgrown toddler has no business being where he is? That every day he stays in office means further degradation of us as a nation? Will they finally figure that their Faustian compact isn’t worth the damage it does to the country? Or will they keep on making excuses for this wretched imitation of a human being?

Advocacy groups vowed to continue their fight for peace and justice on Sunday after the Israeli government announced they are banned from the country for their support of the boycott, divestment, and sanctions movement known as BDS.

“By banning the leaders of peace organizations like CODEPINK, Israel is isolating itself even further as an apartheid state,” said Ariel Gold, national director of CODEPINK. “Their BDS blacklist is contrary to democratic principles and Jewish values. Russia, China, and Iran Join Forces to Bring Down the US Dollar

It is becoming increasingly more common for the corporate media to pay attention to the dollar’s dying status as the world reserve currency. The media can no longer realistically ignore developments that ultimately chip away at the dollar piece by piece considering Russia, China, and Iran have become brazen about their intentions to erode the dominant currency in the not-too-distant future.

While Anti-Media has documented the decline of the dollar throughout the course of the year as a result of a number of significant geopolitical decisions, there is still one major elephant in the room that needs to be addressed. Will anyone protect the Rohingya?

Since August, the Rohingya, an ethnic minority in Myanmar, has faced what a United Nations official called “a textbook example of ethnic cleansing.”

Recent reports describe a campaign by Myanmar security forces to drive the Rohingya from the country permanently. Hundreds of thousands have fled to camps in neighboring Bangladesh, creating a new refugee crisis.

This is exactly the type of atrocity that the United Nations vowed to combat in 2005, when it asserted a “responsibility to protect” civilian populations from genocidal violence. Yet, little has been done.

Why has “the responsibility to protect” failed, and can the Rohingya be helped?

Responsibility to protect

The “responsibility to protect” doctrine resulted from the humanitarian catastrophes of the 1990s: Somalia, Bosnia, Kosovo and especially Rwanda. The world struggled to balance respect for state sovereignty with the imperative to prevent the slaughter of civilians. In 2001, the International Commission on Intervention and State Sovereignty issued a report redefining the problem. It stated that states had primary responsibility to protect their populations. But, if they could not or would not, then that duty could be exercised by the international community.

This concept was affirmed by the United Nations at the 2005 World Summit. However, my research on the origins and implementation of the responsibility to protect has demonstrated that this consensus was superficial. Many states, including the United States and China, gave lip service to a “responsibility to protect,” but were unwilling or unable to implement it. The conditions under which the responsibility to protect could be invoked remain deliberately ambiguous.

Words in action: Libya and Cote d’Ivoire

Despite this tepid support, in 2011, the United Nations authorized two operations in countries where civilians were at risk.

In Cote d’Ivoire, United Nations peacekeeping forces intervened to remove the incumbent president, Laurent Gbagbo, who had lost an election and was using the country’s security force to attack civilians in an attempt to remain in power. U.N. forces helped oversee a political transition and maintain security. This intervention was widely seen at the U.N. as a success.

The other intervention was in Libya, after the country’s leader Muammar Gaddafi threatened to slaughter those who opposed his regime. The intervention – led by Britain, France and the United States – successfully prevented Gaddafi’s slaughter of civilians. But it also led to the collapse of his regime, his murder by rebel forces and continuing conflict in post-Gaddafi Libya.

Failure to protect

Despite humanitarian crises in Syria, Yemen and South Sudan, the responsibility to protect has not been used by the U.N. since 2011 to justify intervention. The Libya case helps to explain this: Once the intervening forces helped overthrow Gaddafi, Russia and China declared that the “responsibility to protect” was merely a pretext for the West to conduct regime change. Those countries have repeatedly vetoed U.N. Security Council resolutions on Syria.

Implementing the “responsibility to protect” faces other challenges as well. One is that an intervention to protect civilians may encounter armed resistance from those who are committing the atrocities, as would likely be the case in Syria. A larger, more capable international military force would be necessary to defeat them. Many states will be deterred by the greater costs and risks of such an intervention.

Another challenge is that states and international organizations have multiple goals and priorities. They may not wish to jeopardize relations with the offending regime, or risk other national interests, in order to stop violence. They may even help the regime that is committing the atrocities, as the Russian government has done in Syria, to advance those interests.

Finally, a successful intervention may lead to a costly commitment to provide long-term security and relief – a “responsibility to rebuild,” so to speak. For most states, these potential costs of intervention far outweigh their willingness to act to save lives.

What can we do for the Rohingya?

All these challenges to implementing the responsibility to protect are evident in the Rohingya case. Myanmar authorities have resisted any international role in the crisis, raising the cost of potential intervention. In any case, other states have little interest in taking action. China is shielding Myanmar from pressure in the U.N. Security Council and is trying to pull Myanmar into its sphere of influence. President Trump has not made Myanmar a priority for American foreign policy. Russia, India and other states prefer to work with the regime to further their own interests in the region.

What can be done, then?

Economic and political sanctions against the Myanmar military are a possibility. But without Chinese participation, they would have limited effectiveness. Sanctions might also lead the Myanmar military to reverse recent democratic reforms in the country.

An alternative would be for the United States and other countries to sharply increase aid to Bangladesh, which is hosting the fleeing Rohingya civilians. They might also consider accepting some Rohingya as refugees. However, this could be problematic given the current debate on refugees in the United States and many other countries.

The ConversationIn the longer term, diplomatic and financial pressure, as well as the possibility of indictment for crimes against humanity, may convince Myanmar’s military leaders to cease the ethnic cleansing and allow some Rohingya to return. Unfortunately, no international cavalry is likely to ride to the Rohingya’s rescue.

As President Donald Trump foments tensions with world powers by behaving recklessly and pursuing aggressive action over diplomacy, developments in several major nations over the weekend sparked urgent concerns among peace groups, activists, and analysts that the world’s largest militaries are inching dangerously close to war.

In response to North Korea’s second intercontinental ballistic missile (ICBM) test late last week, the U.S. on Sunday carried out what the Washington Post called a “show of force” by flying two B-1 bombers over the Korean Peninsula. After Exxon Fined for Sanctions Violations, Calls for Rex Tillerson to Resign

“It’s time Rex Tillerson step down or be removed,” said Gigi Kellett of Corporate Accountability International, following an announcement on Thursday that ExxonMobil will pay $2 million for violating U.S. sanctions against Russian officials while the now-secretary of state was the company’s CEO.

“ExxonMobil demonstrated reckless disregard for U.S. sanction requirements,” according to enforcement filing released by the Treasury Department’s Office of Foreign Assets Control (OFAC), which issued the penalty. Though the fine is reportedly the maximum penalty allowed, it’s pittance to one of the world’s most profitable and powerful corporations, which last year reported a profit of $7.8 billion. ‘Payout Time’: Exxon Seeks Waiver From U.S. Sanctions to Drill in Russia

Exxon is applying for a waiver from the U.S. Treasury Department to bypass U.S. sanctions against Russia and resume offshore drilling in the Black Sea with the Russian oil company Rosneft, the Wall Street Journal reported Wednesday.

Among those charged with deciding to grant the permit is Secretary of State Rex Tillerson, the former CEO of Exxon who previously oversaw the company’s Russia operations. Continue reading
