‘Resounding Victory’: Court Rules Exxon Must Face Trial Over Climate Lies

The Massachusetts high court on Tuesday rejected ExxonMobil’s attempt to dismiss a lawsuit brought by the state, meaning the biggest oil giant in the U.S. must stand trial for allegations that it lied to the public about the climate emergency and the fossil fuel industry’s role in driving it.

The lawsuit filed in 2019 by Massachusetts Attorney General Maura Healey accuses Exxon of violating the state’s consumer protection laws through a decadeslong effort to conceal what it knew about the negative environmental impacts of burning fossil fuels. Continue reading →

International Support Grows for Mexico’s Lawsuit Against US Gun-Makers

In a big boost to the Mexican government’s historic federal lawsuit against American gun-makers, 13 U.S. states, the District of Columbia, two countries, a coalition of attorneys general, and numerous advocacy groups on Monday filed or joined amicus briefs supporting Mexico’s litigation, which seeks to hold weapons manufacturers accountable for the violence they facilitate.

Law.com reports attorneys general from California, Connecticut, Delaware, the District of Columbia, Hawaii, Illinois, Maryland, Michigan, Minnesota, New Jersey, New Mexico, New York, and Oregon joined an amicus brief filed by Massachusetts Attorney General Maura Healey urging a federal court in Boston to deny the gun-makers’ motions to dismiss the suit. President Donald Trump’s Treasury Department has given U.S. banks a green light to seize a portion or all of the one-time $1,200 coronavirus relief payments meant to help Americans cope with financial hardship and instead use the money to pay off individuals’ outstanding debts—a move consumer advocates decried as cruel and unacceptable.

In a win for climate campaigners and Massachusetts’ Democratic Attorney General Maura Healey on Monday, the U.S. Supreme Court rejected ExxonMobil’s attempt to block Healey’s demand for documents related to her state’s ongoing investigation into allegations that one of the world’s largest oil and gas corporations deceived the public and investors for decades about how fossil fuels drive global warming.

“The public deserves answers from this company about what it knew about the impacts of burning fossil fuels, and when,” Healey said, responding on Twitter to the ruling. This victory, she added, “clears the way for our office to investigate Exxon’s conduct toward consumers and investors.” Continue reading →

A Washington, D.C. federal judge has delivered a “crushing defeat” of Education Secretary Betsy DeVos, ruling that the Trump-appointee illegally delayed Obama-era regulations to provide loan relief to students defrauded by for-profit colleges.

U.S. District Court Judge Randolph Moss, in a 57-page ruling (pdf) issued Wednesday, sided with consumer advocates and a coalition of 19 Democratic states attorneys general, determining that DeVos’s actions to delay the borrower defense rule were “unlawful,” “procedurally invalid,” and “arbitrary and capricious.” Continue reading →

Statements from five states’ top legal officers follow ACLU promise to defend against Trump’s “one-man constitutional crisis”

As members of vulnerable communities and their allies gear up for threats the upcoming Donald Trump administration and Republican-controlled Congress could unleash, the top legal officers in at least five states are also preparing, announcing they are ready to be “the first line of defense” to block any constitutional violations.

Reuters reports that the statements come from the state attorneys general in Maryland, Massachusetts, New York, Virginia, and Washington. They are all Democrats.

Massachusetts AG Maura Healey, for example, said in a statement that “[i]f the incoming administration chooses to try to act in ways that are unconstitutional, my office will take action to protect the rights and liberties of our residents and our state.” Continue reading →
