Senate Dems Employ Obscure Law in Effort to Reverse Trump Rollback of Methane Emissions Standards

While lawmakers are also using the Congressional Review Act to challenge one other policy change, it could be used to target dozens of deregulatory actions from Trump’s presidency.

Four members of the Democrat-controlled Senate this week introduced a resolution that would use an “obscure but powerful” federal law to reverse the Trump administration’s weakening of Obama-era rules on fossil fuel companies’ emissions of the potent greenhouse gas methane.

Senate Majority Leader Chuck Schumer (D-N.Y.) along with Sens. Martin Heinrich (D-N.M.), Ed Markey (D-Mass.), and Angus King (I-Maine)—who caucuses with the Democrats—led a larger group of lawmakers Thursday in introducing a resolution of disapproval, under the Congressional Review Act (CRA), to reinstate Obama-era methane rules. ‘The Dam Is Breaking,’ Declare Net Neutrality Defenders After First House Republican Backs CRA

“The dam is breaking, as it should.”

That’s how Faiz Shakir, the ACLU’s national political director, responded on Tuesday after Rep. Mike Coffman of Colorado became the first House Republican to sign a petition to force a vote on a measure that would reinstate net neutrality protections that the GOP-controlled Federal Communications Commission (FCC) rolled back in December.

“Rep. Coffman’s support to undo FCC Chairman Ajit Pai’s repeal of net neutrality shows that public pressure is continuing to build on this issue and cannot be ignored this November,” Shakir added. “Other House members should take heed of Coffman’s direction and stand by the overwhelming majority of their constituents, not corporate interests.” Continue reading →

Accusing Republican Speaker of the House Paul Ryan of thwarting the will of the public by attempting to block lawmakers’ efforts to restore overwhelmingly popular net neutrality protections—which will officially be repealed on June 11th—the entire Senate Democratic caucus sent a letter to Ryan on Thursday demanding that he end his “obstruction” and immediately schedule a vote to preserve the open internet.

“It is incumbent on the House of Representatives to listen to the voices of consumers, including the millions of Americans who supported the FCC’s 2015 net neutrality order, and keep the internet free and open for all,” the Senate Democrats write, urging Ryan to take up a Congressional Review Act (CRA) measure they passed last month with the help of three Republicans. An ultraconservative Republican House caucus on Wednesday put forth its spending plan that represents a draconian wishlist of attacks on the social safety net and consumer and environmental protections while including a plan to further enrich the wealthy by making making permanent parts of the GOP tax plan.

The budget blueprint from the Republican Study Committee (RSC)—and titled A Framework of Unified Conservatism—says it “would take unprecedented steps to begin the deconstruction of the administrative state” and would cut $12.4 trillion over the next decade from federal spending. Continue reading →

Today is the day that net neutrality’s “slow and insidious” death at the hands of the Republican-controlled FCC officially begins, and Congress is facing urgent pressure to save the open internet before it’s too late.

With Monday marking 60 days after the FCC’s net neutrality repeal entered the Federal Register, parts of the GOP-crafted plan—spearheaded by agency chair and former Verizon lawyer Ajit Pai—will now slowly begin taking effect, while some still need to be approved by the Office of Management and Budget. A new rule by a federal watchdog—hailed as having “paramount importance” for protecting consumers from Wall Street predators and curbing corporate abuses—is under direct attack by Republicans just days after being issued.

The rule from the successful and broadly-supported Consumer Financial Protection Bureau (CFPB) bans companies from using mandatory arbitration clauses, which makes consumers give up their right to file or join class-action lawsuits. In other words, it blocks “rip-off clauses” that are “a fine-print trick that banks and predatory lenders use to evade accountability and conceal illegal behavior,” as advocacy group Public Citizen put it, noting that they are also used by many corporations.
