So here we are the day after Election Day—can we just call it Election Week from now on? Or Decision Month if this stretches into December?—and the presidential race again remains undecided.

For the left, this feels all too familiar, the ghost pains of 2016 throbbing in the hole where our souls used to be.

Outcome aside, the fact that this race is even close is a shocking wake-up call for those of us—myself included—who believed that, with the scales off their eyes, Americans would choose decency over crude savagery, compassion over cruelty, professionalism over abject incompetence, honesty over absolute corruption. Trump’s Pennsylvania lawsuits invoke Bush v. Gore – but the Supreme Court probably won’t decide the 2020 election

The Trump campaign has filed two lawsuits in federal court over ballot counting and voting deadlines in Pennsylvania, threatening to take the election to the Supreme Court. Both consciously echo the two main legal theories of Bush v. Gore, the infamous Supreme Court case that decided the contested 2000 presidential election.

But this race is not likely to be decided by the Supreme Court.

There are several reasons, sitting at the intersection of law and politics, why the ghosts of Florida past won’t rise again in Pennsylvania. As a law professor who’s authored a book on election reform, I rate success in Trump’s efforts to wrench back Biden’s lead through litigation as a real long shot, though not out of the question. Election experts and other critics of voter suppression responded with alarm Tuesday after the United States Postal Service failed to meet a court-ordered afternoon deadline to conduct sweeps at mail processing facilities to “ensure that no ballots have been held up and that any identified ballots are immediately sent out for delivery.”

Earlier Tuesday, U.S. District Judge Emmet Sullivan of the District of Columbia had ordered the sweeps between 12:30 pm and 3:00 pm ET, and set a 4:30 pm ET deadline for facilities to file a status update. John Kruzel, a reporter at The Hill, tweeted Tuesday afternoon that the USPS failed to comply, in spite of saying this week that about 300,000 ballots had entered the mail sorting system but lacked a delivery scan. Pursuing trade and industrial policies that boost U.S. exports and eliminate the trade deficit while investing $2 trillion over four years in the nation’s infrastructure, clean energy, and energy efficiency improvements could support 6.9 to 12.9 million “good jobs” annually by 2024, according to an analysis published Tuesday.

The new report from a trio of experts at the Economic Policy Institute (EPI), a U.S.-based think tank, comes as the country continues to endure the public health and economic consequences of the ongoing coronavirus pandemic, which has claimed more than 220,000 lives and millions of jobs in the United States alone this year. On top of mounting court injunctions and ongoing investigations by members of Congress, Postmaster General Louis DeJoy is running up against another key source of resistance as he attempts to implement sweeping changes to the U.S. mail service just ahead of the November election: letter carriers and other rank-and-file Postal Service employees.

Angered by DeJoy’s efforts to overhaul longstanding USPS policies designed to ensure mail is delivered on time, postal workers across the nation have been slow-walking and outright defying instructions from leadership to leave mail behind, dismantle sorting machines, and cut back on overtime in an effort to limit the damage to a service that millions rely on to vote, receive life-saving medications, and run small businesses. 23 AGs Sue Trump Council Over ‘Reckless and Unprecedented’ Gutting of Bedrock US Environmental Law

A coalition of 27 U.S. states, commonwealths, territories, counties, and cities filed a federal lawsuit on Friday challenging the Trump administration’s “unlawful, unjustified, and sweeping revisions” to a 50-year-old law that the president claimed would “streamline” infrastructure projects by limiting environmental reviews.

After revealing plans to alter the National Environmental Policy Act (NEPA) in January, President Donald Trump announced what critics called “reckless and unprecedented” changes during a July campaign stop. The revisions, detailed in a final rule released by the White House Council on Environmental Quality (CEQ), swiftly provoked legal threats from advocacy organizations. Continue reading →

‘Wild and Timely’ Report Details Infiltration of Far-Right Militias and White Supremacist Groups in US Police Departments

As law enforcement agencies and lawmakers respond to nationwide outrage over countless police shootings of Black Americans with pledges to address racial profiling and “implicit bias,” the Brennan Center for Justice released a report Thursday on what it called “an especially harmful form of bias, which remains entrenched within law enforcement: explicit racism.”

The presence of virulent racism within police ranks across the country has grown over the past two decades, Brennan Center fellow and former FBI special agent Michael German wrote in the report, as white supremacist and far-right militant groups have infiltrated law enforcement agencies. Amid a national wave of uprisings against police brutality in response to last week’s brutal murder of George Floyd in Minneapolis, Minnesota—but in contrast to a wave of aggressive and violent responses from law enforcement to those demonstrations—a scene in Flint, Michigan that played out Saturday evening offered an alternative to aggressive police tactics as a local sheriff and his fellow officers laid down their riot gear and joined with those members of the community who came out to voice their outrage and sorrow.

When Genesee County Sheriff Chris Swanson, his deputies, and local officers were confronted by community members who marched on the Flint Township police station, witnesses described how Swanson told the crowd he wanted their pleas to be heard and that the police wanted to be in service of their demands and the protest itself. ‘About Damn Time’: Detroit Pauses Water Shutoffs Amid Coronavirus Outbreak

Progressives heaped praise on grassroots activists in Detroit on Monday after the Michigan city announced, amid the spread of the coronavirus, it was temporarily restoring water services to thousands of residents who’ve had their water shut off.
